DISTANCE SALES AGREEMENT
Parties
This Passenger Transport and Service Agreement (Agreement) is made between www.kcanturizm.com (hereinafter referred to as “K-CAN TURIZM”) and the passengers who make a reservation via www.kcanturizm.com or on whose behalf a reservation is made (hereinafter referred to as “Passenger”).
Unless otherwise specified in this Agreement, “K-CAN TURIZM” and “Passenger” are individually referred to as “Party” and collectively as “Parties.”
Subject
With this Agreement, the Parties agree on the provision of airport transfer services within Turkey, both before and after the flight, for passengers who have purchased transfer services between the airport-address or address-airport routes, using the designated vehicles. The transfer service will be provided for the agreed payment, which will be collected by “K-CAN TURIZM.”
Service and Payment Information
3.1 The contract price, including VAT, is specified in the service details.
3.2 I accept that all payments for the transfer service purchased and/or to be purchased through this Agreement will be collected by K-CAN TURIZM via my credit card, and I authorize K-CAN TURIZM to make the credit card charge.
3.3 The invoice for the purchased service will be issued within 7 days from the purchase date, including the day of purchase, provided that there is no month gap as required by the Turkish Tax Procedure Law (V.U.K.).
Payment Method: Bank Card or Credit Card.
General Terms
4.1 The Passenger is required to comply with all relevant laws, including the Traffic Law, and is obligated to follow safety rules such as wearing seat belts and adhering to safety rules inside the vehicle.
4.2 When the Passenger purchases the transfer service with a credit card or debit card, they accept the written terms of the relevant contract, even if the user has not signed the service contract.
4.3 The Passenger must make a reservation at least 2 hours before the transfer time to benefit from the transfer service. On religious and national holidays, New Year’s Day, and other official holidays, reservations must be made at least 24 hours before the transfer time. The reservation can be canceled by the Passenger at least 24 hours before the transfer time, in which case the payment for the service will be refunded. No refunds will be made for cancellations outside of the specified time frames.
4.4 The Passenger does not have the right to change the route for the journey. Requests to stop at different locations or wait for a period at a location will not be accepted. In the case of VIP transfer services, any request for a stop at a different location not specified in the agreement will incur an additional charge for each additional stop.
4.5 K-CAN TURIZM is obligated to assign an appropriate vehicle based on the number of passengers and luggage capacity specified by the Passenger at the time of reservation. K-CAN TURIZM guarantees that all vehicles used for this service will be insured for personal accidents and seat coverage, will undergo periodic maintenance, and will have mandatory equipment such as a spare tire, first aid kit, fire extinguisher, and reflectors. In case of an accident or damage to the goods during the transfer, K-CAN TURIZM will not be held responsible. The Passenger accepts and declares in advance that K-CAN TURIZM will have no liability under the Turkish Code of Obligations Article 66 and other relevant regulations in such cases.
4.6 The information provided by the Passenger regarding the number of passengers and baggage at the time of reservation will be accepted by K-CAN TURIZM. If this exceeds the allowed limits, the excess passengers or baggage cannot be accepted into the vehicle. If the Passenger cancels the service for this reason, no refund will be made.
4.7 If necessary, the Passenger must prove that they are the customer who purchased the service by presenting identification documents and the reservation details. If the Passenger fails to provide this documentation, the transfer will not be made. However, if K-CAN TURIZM believes that the credit card holder has consented to the Passenger using the service, the service may still be provided.
4.8 K-CAN TURIZM is not responsible for any lost or damaged items left inside the vehicle during the transfer. The Passenger must immediately contact K-CAN TURIZM’s call center if they realize they have forgotten an item. If the lost item is found, the Passenger must collect it from the address specified by K-CAN TURIZM. If the Passenger requests, the forgotten item can be delivered to the specified address for a fee.
4.9 K-CAN TURIZM does not accept large bags such as sacks, trunks, or boxes. The Passenger is allowed a maximum of 1 handbag and 1 suitcase (Handbag: 8 kg, suitcase: 32 kg maximum). The Passenger accepts and declares that there will be no flammable, explosive, or other prohibited items as per Turkish regulations in the luggage. If any prohibited items are found by the driver, the luggage will not be accepted. The Passenger will not have the right to claim any compensation from K-CAN TURIZM in this case.
4.10 Pets can be transported in secure cages in the vehicle, with prior notice at the time of booking. Only cats, dogs, and small birds are allowed as pets.
4.11 Passenger Information
4.11.1 The Passenger’s reservation information will be shared via email and/or SMS. The accuracy of the phone and email information provided by the Passenger is their responsibility. K-CAN TURIZM cannot be held responsible for any failure to deliver notifications due to incorrect contact information.
4.11.2 For shared transfers, the estimated pickup time will be shared with the Passenger via email and/or SMS 12 hours prior to the transfer. For VIP services, the service will be provided according to the time specified by the Passenger.
4.12 In transfers from a specific point to the airport, K-CAN TURIZM guarantees that the vehicle will be at the specified location at the scheduled transfer time. The transfer details, including time, will be communicated to the Passenger via email and SMS in advance. A delay of up to 20 minutes after the scheduled transfer time due to extraordinary circumstances, such as weather conditions or traffic, is considered a reasonable delay.
4.13 In case of delays longer than 2 hours, K-CAN TURIZM will no longer be obligated to wait at the airport. For shared transfers, K-CAN TURIZM will provide the service according to vehicle availability and timing. VIP service will be provided with an appropriate vehicle.
4.14 K-CAN TURIZM is responsible for ensuring the vehicle arrives on time at the designated locations. In case of any issues preventing the vehicle from reaching its destination, K-CAN TURIZM will provide an alternative vehicle at no additional charge. If the second vehicle fails to arrive on time, K-CAN TURIZM will cover all alternative transportation expenses for the Passenger to reach the airport. If the Passenger uses another means of transport (e.g., taxi, public transport, private car), K-CAN TURIZM will either provide the service again at no extra charge or refund the amount paid.
4.15 The driver is not obligated to escort the Passenger to the vehicle or accompany them to their home.
4.16 Children under 18 will not be transported without an adult accompanying them or without their family’s consent.
4.17 For shared transfers, if a wheelchair is required, the Passenger must indicate this at the time of reservation. Otherwise, K-CAN TURIZM will not be responsible for any delays or inability to board the vehicle due to this issue.
4.18 If the Passenger uses a non-Turkish bank credit card to purchase online tickets, additional transaction fees may apply. The Passenger should contact their bank for more details.
4.19 Passengers without infectious diseases and who are medically cleared for travel can be accepted for transfer with a doctor’s report stating “no objection to travel,” prepared no later than 20 days before the transfer.
4.20 Due to operational reasons at the airports, the vehicle will arrive to pick up the Passenger within a minimum of 10 minutes and a maximum of 20 minutes. In cases where departure is from an address, there is a 15-minute delay allowance.
4.21 Seat belts are mandatory in vehicles. If the Passenger does not comply, the driver has the right to stop the journey and terminate the service. The Passenger accepts responsibility for any damage caused by failure to wear a seatbelt.
4.22 Vehicles are equipped with cameras to record the journey. These recordings are only stored on the vehicle’s system and cannot be shared with any third party. The recordings will be kept for a period of 7 days. Passengers acknowledge that they are being recorded inside the vehicle.
